We strive to provide accurate product descriptions, images, fitment data, and pricing on our Site. However, we do not warrant that product descriptions, fitment information, pricing, or other content is accurate, complete, or error-free.

Fitment Disclaimer

Our Site provides vehicle fitment information (Year, Make, Model, Submodel) to assist you in finding compatible parts. While we make every effort to maintain accurate fitment data:

  • Fitment information is provided as a guide only and does not constitute a guarantee of compatibility
  • It is the customer's responsibility to verify that a part is compatible with their specific vehicle before purchasing
  • We are not liable for parts purchased based on fitment data that do not fit your vehicle due to modifications, trim variations, or data inaccuracies

Pricing

All prices are listed in US Dollars (USD) and are subject to change without notice. In the event of a pricing error, we reserve the right to cancel the order and issue a full refund, or contact you with the option to proceed at the corrected price.

4. Orders and Payment

Order Acceptance

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason, including but not limited to:

  • Product availability
  • Pricing errors
  • Suspected fraudulent activity
  • Order quantity limitations

Payment

We accept payment methods as displayed at checkout. By submitting payment information, you represent that you are authorized to use the payment method provided. All payments are processed through secure, PCI-compliant payment processors.

Order Confirmation

An order confirmation email does not constitute acceptance of your order. Your order is accepted when the item is shipped and a shipping confirmation is sent.

5. Shipping and Delivery

Orders are fulfilled by our distribution partners and shipped directly to you. For complete details on shipping methods, timeframes, and costs, please refer to our Shipping Policy.

Title and Risk of Loss

Title and risk of loss for items purchased from us pass to you upon delivery of the items to the shipping carrier. We are not responsible for items lost or damaged during transit by the carrier.

6. Returns, Refunds, and Cancellations

Our return, refund, and cancellation policies are detailed in our Return & Refund Policy. By making a purchase, you agree to the terms outlined in that policy, including:

  • 14-day return window from the date of delivery
  • 15% restocking fee on approved returns (except defective/incorrect items)
  • Return shipping is the customer's responsibility (except defective/incorrect items)
  • Certain categories of items are non-returnable
  • Special order items cannot be returned or cancelled

7. Off-Road Use Only / Emissions Disclaimer

Unless explicitly stated otherwise, products sold on our Site are intended for off-road, competition, or racing use only. These products may not be legal for use on public roads or highways.

  • It is the customer's sole responsibility to verify the legality of any product for their intended use in their jurisdiction
  • We do not implicitly or explicitly confirm the legality of using any product on public roads
  • We are not liable for any fines, penalties, or consequences resulting from the use of products in violation of applicable laws or regulations
  • Customers should review local, state, and federal emissions and vehicle modification laws before purchasing

8. Warranty Disclaimer

We do not provide any warranty on the products we sell. All products are covered solely by the manufacturer's warranty, if any.

  • Warranty claims must be directed to the product manufacturer
  • We may assist in facilitating warranty claims, but we are not obligated to do so
  • Credit or replacement for defective merchandise is subject to manufacturer inspection and approval
  • Return shipping for warranty claims is the customer's responsibility unless the manufacturer agrees to cover it

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • Sabaku Base LLC, its members, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of products
  • Our total liability for any claim arising from these Terms or your use of the Site shall not exceed the amount you paid for the specific product giving rise to the claim
  • We are not liable for damages resulting from improper installation, misuse, or modification of products purchased from us
  • We are not liable for delays, failures, or interruptions in service caused by events beyond our reasonable control

10. Indemnification

You agree to defend, indemnify, and hold harmless Sabaku Base LLC, its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from:

  • Your use of the Site or violation of these Terms
  • Your purchase, installation, or use of products bought through the Site
  • Any violation of applicable laws or regulations
  • Any dispute between you and a third party related to products purchased on the Site

11. Intellectual Property

All content on this Site, including text, graphics, logos, images, and software, is the property of Sabaku Base LLC or its content suppliers and is protected by United States copyright and intellectual property laws.

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising from these Terms or your use of the Site shall be resolved as follows:

  1. Informal Resolution: You agree to first attempt to resolve any dispute informally by contacting us at contact@sabaku-parts.com. We will attempt to resolve the dispute within 30 days.
  2. Binding Arbitration: If the dispute cannot be resolved informally, it shall be resolved through binding arbitration administered in the State of California, in accordance with the rules of the American Arbitration Association (AAA).
  3. Class Action Waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, class arbitration, or consolidated proceeding.

Small Claims Exception

Notwithstanding the above, either party may bring a claim in small claims court if the claim qualifies.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
